Child Custody & Guardianship

Protecting parental rights and prioritizing the paramount welfare of the child in custody and visitation battles.

Family Law

Protecting parental rights and prioritizing the paramount welfare of the child in custody and visitation battles.

Child custody disputes during marital separation are emotionally charged. Courts decide custody matters based on the supreme legal doctrine: the "Paramount Welfare of the Child" under the Guardians and Wards Act 1890 and personal laws.

Bail & Trial represents mothers and fathers in Family Courts. We advocate for physical custody, shared parenting plans, weekend/holiday visitation rights, and emergency protection against parental alienation and child abduction.

FAQ about Child Custody & Guardianship

  • Who gets custody of a child under 5 years of age in India?
Under Section 6(a) of the Hindu Minority and Guardianship Act 1956, custody of a minor child who has not completed the age of 5 years is ordinarily awarded to the mother, unless the father proves she is unfit.
  • What is the "Paramount Welfare of the Child" doctrine?
The Supreme Court has consistently held that in custody disputes, the paramount consideration is the overall welfare of the child (emotional, educational, psychological, and physical well-being), which supersedes the statutory rights of either parent.
  • Does a non-custodial father have a legal right to meet and visit his child?
Yes. Courts recognize that a child requires the love and affection of both parents. The non-custodial parent has a legal right to regular physical visitation, overnight weekend stays, and phone/video access.
  • At what age can a child decide which parent they want to live with?
Under Section 17(3) of the Guardians and Wards Act, if the child is old enough to form an intelligent preference (typically 9 years and older), the Family Court judge will interview the child in chambers to consider their wishes.
  • Can a mother or father take the child abroad without the other parent's consent?
No. Unilaterally removing a child out of the country without the other parent's consent or court permission can lead to international parental child abduction proceedings and Habeas Corpus orders.
