Have Questions?

FAQ about Child Support

  • Until what age is a father or mother obligated to pay child support in India?
Under Indian law, child support is mandatory until a son attains the age of majority (18 years). For an unmarried daughter, maintenance must be provided until she gets married or becomes financially self-sufficient.
  • Can parents mutually agree to waive child support in a divorce settlement?
No. The Supreme Court has ruled that the right to maintenance belongs to the child, not the parent. Any clause in a divorce settlement waiving child support is void and contrary to public policy.
  • What happens if a parent refuses to pay court-ordered child support?
The court can issue recovery warrants, attach the defaulting parent's bank accounts and salary, or order civil imprisonment for willful non-payment of maintenance arrears.
  • How is child support calculated by Family Courts in India?
Courts do not use a rigid mathematical formula; they evaluate the child's schooling, healthcare, extracurriculars, and standard of living relative to both parents' net incomes and liabilities under Rajnesh v. Neha guidelines.
  • Can child maintenance be increased if school fees or cost of living rise?
Yes. Under Section 127 CrPC / Section 26 HMA, a custodial parent can file an application for enhancement of child maintenance upon showing changed circumstances, such as higher school fees or inflation.
