Have Questions?

FAQ about Domestic Violence Protection

  • What qualifies as "Domestic Violence" under the PWDVA 2005?
The Act defines domestic violence broadly to include: physical harm, sexual abuse, verbal/emotional harassment (insults, ridicule, name-calling), and economic abuse (depriving of money, food, or disposing of Streedhan).
  • Can a woman be thrown out of the house by her husband or in-laws?
No. Under Section 19 of the Domestic Violence Act, every woman in a domestic relationship has a right to reside in the "shared household" and cannot be dispossessed or excluded except in accordance with the procedure established by law.
  • What is the consequence if the abuser violates a Section 18 Protection Order?
Under Section 31 of the PWDVA, breach of a court protection order is a cognizable and non-bailable criminal offense punishable with imprisonment up to 1 year and a fine up to Rs. 20,000.
  • Can distant in-laws or married sisters-in-law be implicated in a DV case?
While complaints often name distant in-laws, the Supreme Court has ruled that relatives who did not share a common household cannot be dragged into DV litigation, and High Courts will quash their names under Section 482 CrPC.
  • Can a man file a Domestic Violence complaint under the PWDVA 2005?
The PWDVA 2005 is a gender-specific law intended to protect aggrieved women. Men cannot file complaints under the PWDVA, but can seek remedies under general criminal law (BNS/IPC) or civil injunctions in cases of physical violence.
