Have Questions?

FAQ about Forgery Cases

  • Can a handwriting expert opinion alone lead to conviction?
No. Handwriting expert opinion under Section 45 of the Evidence Act is corroborative evidence only. Courts require independent evidence of forgery.
  • Can an expert examine signatures on a photocopy?
Examining handwriting on a photocopy is generally unreliable because pressure, stroke flow, and hesitations cannot be verified. Originals are required.
  • What is the punishment for forging a valuable security or property deed?
Under Section 467 IPC (Sec 338 BNS), forging a valuable security, will, or property deed carries imprisonment up to life or 10 years.
  • What is the procedure for obtaining Anticipatory Bail under criminal law?
Anticipatory bail is filed before the Sessions Court or High Court under Section 438 CrPC / Sec 482 BNSS when a person apprehends arrest in a non-bailable offense, preventing police detention.
  • What is the legal difference between bailable and non-bailable offenses?
In bailable offenses, bail is a statutory right granted at the police station or magistrate court. In non-bailable offenses, granting bail is at the judicial discretion of the court.
