Property Law

Legal representation for eviction proceedings, lease drafting, rental arrears recovery, and security deposit disputes.

Tenancy disputes over unlawful eviction, commercial lease defaults, non-refund of security deposits, and breach of lease covenants require strategic intervention under the Karnataka Rent Act 1999 and Transfer of Property Act 1882.

Have Questions?

FAQ about Landlord Tenant Issues

  • Can a landlord forcefully throw out a tenant or cut electricity/water?
No. Cutting off essential supplies (water, electricity) or forcibly locking a tenant out is strictly illegal. The landlord must follow due process of law by obtaining an eviction order from a competent court.
  • What is the mandatory notice period required to terminate a monthly tenancy?
Under Section 106 of the Transfer of Property Act 1882, a 15-day written notice expiring with the end of the tenancy month is mandatory to terminate a residential lease.
  • Why are most residential rental agreements signed for 11 months?
Under Section 17 of the Registration Act, leases for a period of 1 year or more require compulsory registration and higher stamp duty. An 11-month agreement avoids compulsory registration while remaining legally valid when properly stamped.
  • What legal remedy does a tenant have if the landlord refuses to refund the security deposit?
The tenant can issue a formal legal demand notice claiming refund with interest, followed by filing a recovery suit in the Small Causes Court or a consumer complaint for deficiency in service.
  • What are "mesne profits" in an eviction suit?
Mesne profits are damages awarded to a landlord by the court against an unauthorized occupant or overstaying tenant, calculated on the prevailing market rental value of the property for the entire period of wrongful possession.
