FAQ about Legal Separation

  • What is the main difference between Judicial Separation and Divorce in India?
A Divorce completely dissolves the marriage, allowing both parties to remarry. Judicial Separation does NOT end the marriage (neither can remarry), but legally suspends the obligation of spouses to live together.
  • Can either spouse get a divorce after a decree of Judicial Separation?
Yes. Under Section 13(1A)(i) of the Hindu Marriage Act, if spouses do not resume cohabitation for a period of 1 year or more after the judicial separation decree, either party can apply for a divorce.
  • Can a wife claim maintenance during Judicial Separation?
Yes. A wife is fully entitled to claim interim and permanent maintenance under Section 25 of the Hindu Marriage Act and Section 125 CrPC during the period of judicial separation.
  • What happens if a couple reconciles during Judicial Separation?
If the couple decides to live together again, they can jointly apply to the Family Court under Section 10(2) of the Hindu Marriage Act to rescind or cancel the decree of judicial separation.
  • Is an informal living apart agreement legally binding in India?
A private written separation agreement is a valid contract regarding division of assets and maintenance, but it does NOT have the status of a judicial separation decree unless ratified by a court.
