FAQ about Maintenance & Spousal Support

  • Can a working or educated wife claim maintenance in India?
Yes. Even if a wife is educated or earning, she can claim maintenance if her income is insufficient to maintain the standard of living she enjoyed during the marriage, as held by the Supreme Court.
  • From what date is maintenance awarded by the court?
Under the landmark Supreme Court ruling in Rajnesh v. Neha (2020), maintenance is awarded from the DATE OF APPLICATION (filing date), and the respondent must pay all accumulated arrears.
  • What is the "Rajnesh v. Neha" guideline for maintenance?
The Supreme Court mandated that both spouses must file a standardized comprehensive Affidavit of Assets and Liabilities disclosing all bank accounts, ITRs, properties, loans, and expenses to ensure fair calculation.
  • Can a husband be sent to jail for not paying maintenance?
Yes. Under Section 125(3) CrPC / Section 144(3) BNSS, if a person fails without sufficient cause to comply with a maintenance order, the Magistrate can issue a warrant and sentence them to imprisonment up to 1 month for each month of unpaid arrears.
  • Can maintenance be modified if the husband loses his job or the wife gets a higher salary?
Yes. Under Section 127 of the CrPC / Section 25(2) HMA, either party can apply for alteration or reduction of maintenance upon proving a material change in financial circumstances.
