Have Questions?

FAQ about Money Laundering Cases

  • Can PMLA proceedings continue if the main predicate FIR is quashed?
No. The Supreme Court in Vijay Madanlal Choudhary held that if the accused is acquitted or the scheduled offense FIR is quashed, PMLA proceedings cannot survive.
  • Are statements recorded under Section 50 ED admissible in court?
Unlike statements to police, statements recorded by ED officers under Section 50 PMLA are admissible in evidence, making immediate legal representation essential.
  • How long can ED provisionally attach a property?
A Provisional Attachment Order issued by ED under Section 5 remains valid for up to 180 days, within which it must be confirmed by the Adjudicating Authority.
  • What is the procedure for obtaining Anticipatory Bail under criminal law?
Anticipatory bail is filed before the Sessions Court or High Court under Section 438 CrPC / Sec 482 BNSS when a person apprehends arrest in a non-bailable offense, preventing police detention.
  • What is the legal difference between bailable and non-bailable offenses?
In bailable offenses, bail is a statutory right granted at the police station or magistrate court. In non-bailable offenses, granting bail is at the judicial discretion of the court.
