Have Questions?

FAQ about Property Disputes

  • What is the limitation period for filing a suit for Declaration of Title in India?
Under Article 58 of the Limitation Act 1963, a suit for Declaration of Title must be filed within 3 years from the date when the right to sue first accrues (i.e. when ownership is denied or cloud on title arises).
  • How can I stop someone from encroaching or constructing on my plot immediately?
You can file a Civil Suit accompanied by an application under Order 39 Rules 1 & 2 CPC seeking an immediate ex-parte temporary injunction restraining the trespasser from entering or carrying out construction.
  • What is Adverse Possession and when can someone claim it?
Under Article 65 of the Limitation Act, a person who continuously, openly, and hostiley occupies private land for 12 uninterrupted years can claim title by adverse possession. Lawful owners must take legal action before the 12-year window expires.
  • What is the difference between a Civil Court suit and a Revenue Appeal under the KLR Act?
Civil Courts determine ownership, title, and possessory rights through binding decrees. Revenue Authorities (Tahsildar, AC, DC) only maintain fiscal records (Khata, RTC) for tax collection and cannot decide disputed questions of title.
  • What should I do if a fraudulent sale deed has been registered on my property by an impersonator?
You must immediately file a Civil Suit for cancellation of the fraudulent deed under Section 31 of the Specific Relief Act and lodge an FIR under Section 420/468 IPC with the cyber/economic offenses police.
