Have Questions?

FAQ about Property Inheritance and Succession

  • Do daughters have an equal share in ancestral property even if born before 2005?
Yes. In Vineeta Sharma v. Rakesh Sharma (2020), the Supreme Court ruled that daughters have coparcenary rights by birth on equal footing with sons, irrespective of whether the father or daughter was born before 2005.
  • What is the legal difference between ancestral property and self-acquired property?
Ancestral property is inherited through four generations of male lineage and cannot be sold without the consent of all coparceners (except for legal necessity). Self-acquired property belongs solely to the buyer, who can sell, gift, or will it to anyone.
  • What happens if a person dies intestate (without a will) in India?
If a Hindu male dies intestate, his property is distributed equally among his Class I legal heirs: his mother, widow, and children (sons and daughters) in equal shares under Section 8 of the Hindu Succession Act.
  • What is the difference between a Preliminary Decree and a Final Decree in a partition suit?
A Preliminary Decree determines the specific legal share/percentage of each co-owner. A Final Decree physically divides the property by metes and bounds through a Court Commissioner's survey.
  • Can a family member sell their undivided share in ancestral property to an outside third party?
A coparcener can transfer their undivided interest, but the buyer cannot obtain joint physical possession of the family dwelling house without filing a civil suit for partition and separate possession under Section 44 of the Transfer of Property Act.
