Have Questions?

FAQ about Property Sale, Lease, Mortgage & Gift

  • Can a registered Gift Deed be cancelled by the donor later?
No. Under Section 126 of the Transfer of Property Act, once a Gift Deed is duly registered and accepted by the donee, it CANNOT be unilaterally cancelled by the donor (except on grounds of fraud, coercion, or under Senior Citizens Act provisions).
  • What is the difference between a Lease and a Leave & Licence agreement?
A Lease transfers an interest in immovable property with exclusive possession, whereas a Leave & Licence only grants permission to occupy the premises without creating any tenancy or proprietary interest.
  • Is an unregistered Agreement to Sell legally valid in court?
An unregistered Agreement to Sell cannot be used to prove transfer of possession under Section 53A, but it CAN be admitted as evidence in a suit for Specific Performance to compel the seller to execute the sale deed.
  • What is the stamp duty on a Gift Deed to family members in Karnataka?
In Karnataka, gift deeds executed in favor of specified family members (spouse, children, grandchildren, siblings) attract a concessional fixed stamp duty and registration fee rather than standard 5% ad-valorem duty.
  • What is a "Relinquishment Deed" and when is it used?
A Relinquishment (Release) Deed is a registered legal instrument used by co-owners or legal heirs to give up or surrender their legal share in an inherited property in favor of other co-owners.
