Have Questions?

FAQ about Real Estate

  • What relief can a homebuyer get under RERA if a builder delays possession?
Under Section 18 of RERA, a buyer can either: 1) Withdraw from the project and claim full refund of money paid along with prescribed interest (SBI MCLR + 2%), or 2) Stay in the project and receive monthly delayed interest until possession.
  • Is an Occupancy Certificate (OC) mandatory before moving into a newly built apartment?
Yes. An Occupancy Certificate (OC) issued by BBMP/local authority certifies that the building has been constructed according to approved plans. Occupying without OC is illegal and poses risk of water/power disconnection.
  • What is the difference between Carpet Area, Built-up Area, and Super Built-up Area?
Carpet Area is the net usable floor area inside internal walls. Built-up Area includes external walls and balconies. Super Built-up Area adds common areas (lifts, corridors, clubhouse). Under RERA, builders must sell flats based on CARPET AREA only.
  • How does a homebuyer enforce a RERA refund order if the builder refuses to pay?
Under Section 40 of RERA, if a promoter fails to pay the ordered amount, the RERA Authority issues a Recovery Certificate to the District Collector to recover the money as arrears of land revenue through bank attachment.
  • What should a landowner verify before signing a Joint Development Agreement (JDA)?
A landowner must verify the developer's past delivery record, structure an irrevocable revenue or area sharing ratio, mandate bank guarantees, and retain control over the Power of Attorney until construction milestones are met.
