Have Questions?

FAQ about Title Deed Registration

  • What is the time limit for registering a document after it is executed?
Under Section 23 of the Registration Act 1908, a document must be presented for registration within 4 months from the date of its execution. An extension of up to 4 additional months may be allowed with penalty.
  • What is the current Stamp Duty and Registration Fee in Karnataka for property sale?
In Karnataka, stamp duty on sale deeds is typically 5% (plus applicable surcharges and cesses) and the registration fee is 2% of the guidance value or consideration value, whichever is higher.
  • What is a "Rectification Deed" and when is it required?
A Rectification Deed (or Correction Deed) is a supplementary registered instrument executed by buyer and seller to correct inadvertent errors (such as typographical mistakes in survey numbers, plot dimensions, or names) in the original registered deed.
  • What is the difference between Form 15 and Form 16 Encumbrance Certificate (EC)?
Form 15 lists all registered transactions, mortgages, and sales recorded on the property for the requested period. Form 16 is a "Nil Encumbrance Certificate", issued when no transactions are recorded on the property.
  • Can property be registered online without physically visiting the Sub-Registrar office?
While Karnataka's Kaveri 2.0 portal allows online document submission, e-stamping, and appointment booking, the parties and two witnesses MUST physically visit the Sub-Registrar office for biometric authentication and photograph verification.
