Warranty Claims

Enforcing consumer guarantees and fighting denied warranty claims.

Consumer Law

Enforcing consumer guarantees and fighting denied warranty claims.

When you purchase a high-value item like a vehicle, appliance, or electronics, the warranty provides peace of mind. However, manufacturers frequently employ loopholes, fine print, or outright bad faith tactics to deny legitimate warranty repairs or replacements.

Bail & Trial helps consumers enforce their rights under express and implied warranties. We deal with uncooperative manufacturers and litigate lemon law claims to ensure you get the functioning product or refund you paid for.

FAQ about Warranty Claims

  • What is the Magnuson-Moss Warranty Act?
It is a federal law that governs consumer product warranties. It prevents companies from using deceptive disclaimers and often requires them to pay your attorney fees if you win a lawsuit against them.
  • What is an implied warranty?
Even if a product doesn't come with a written warranty, the law implies a warranty of "merchantability," meaning the product must basically work as expected for its normal purpose.
  • Can my car warranty be voided if I change my own oil?
No. Under the law, a manufacturer cannot void your warranty simply because you used aftermarket parts or performed routine maintenance yourself, unless they can prove your actions directly caused the defect.
  • What is the limitation period for filing a complaint before the Consumer Commission?
Under Section 69 of the Consumer Protection Act 2019, a consumer complaint must be filed within 2 years from the date on which the cause of action arose.
  • Can I claim compensation for mental harassment and legal expenses in a consumer dispute?
Yes. Consumer Commissions routinely award compensation for mental agony, emotional distress, and legal costs alongside refund or product replacement orders.
