Have Questions?

FAQ about Wills & Estate Planning

  • Is it legally mandatory to register a Will in India?
No. Registration of a Will is optional under Section 18 of the Registration Act. An unregistered Will is completely valid if executed properly by a person of sound mind in the presence of two attesting witnesses. However, registration adds strong evidentiary value.
  • Can a person change or revoke their Will after writing it?
Yes. A Will is revocable and can be altered or completely revoked by the testator at any time during their lifetime, as long as they possess a sound disposing mind.
  • What is a "Probate" and is it mandatory in Bangalore?
A Probate is a legal certificate issued by a competent civil court certifying the authenticity of the Will. Under Section 213 of the Indian Succession Act, probate is mandatory for wills executed in Chennai, Mumbai, or Kolkata, but is optional in Bangalore unless property is situated in those metropolitan jurisdictions or disputed.
  • Can a beneficiary under a Will also be an attesting witness?
No. Under Section 67 of the Indian Succession Act, if a beneficiary (or their spouse) signs as an attesting witness, the bequest to that person becomes void. Witnesses must be independent individuals.
  • What is a "Codicil" in estate planning?
A Codicil is a formal legal document used to make minor alterations, additions, or revocations to an existing Will without having to rewrite the entire Will from scratch.
