FAQ about Arbitration

  • What is the significance of Section 9 of the Arbitration Act?
Section 9 allows a party to approach the High Court or Commercial Court for urgent interim relief (like attaching assets or restraining bank guarantee encashment) BEFORE or during arbitration.
  • What is the time limit for completing an arbitration in India?
Under Section 29A, the Arbitral Tribunal MUST pass the award within 12 months from the date of completion of pleadings (extendable by 6 months with consent of parties).
  • On what grounds can an arbitral award be challenged under Section 34?
Section 34 allows challenging an award ONLY on narrow grounds: incapacity of parties, invalid agreement, lack of proper notice, dispute beyond scope, or patent illegality breaching public policy.
  • What is the statutory process for compounding technical MCA defaults?
Under Section 441 of the Companies Act 2013, a company can file a compounding application admitting technical non-compliance, pay a reduced fine to NCLT/RD, and avoid court prosecution.
  • What are the consequences of non-compliance with annual ROC filings?
Delayed AOC-4 and MGT-7 filings incur daily additional late fees of Rs. 100 per day, director DIN disqualification for 3 consecutive years of non-filing, and risk of company strike-off.
